Minnesota has laws that explicitly protect public waters, including the rivers and streams listed in the state’s public waters inventory. But the public waters inventory hasn’t been updated in four decades, and there are hundreds of miles of waterways in potential legal limbo. After the Minnesota Supreme Court ruled on the Limbo Creek decision, the Court asked the Legislature to clarify which other waters are public.
HF 3385 (Purcell) / SF 3558 (Kunesh) is a commonsense bill that would ensure all rivers and streams that fit the definition of a public water in law are fully protected. That means long-term security for hundreds of miles of streams on which people and wildlife depend.
